Pakistani daily wonders why no tax on agriculture | Business ...

Islamabad, May 31 (IANS) For decades Pakistan has ?flirted with the idea of imposing taxes on the agricultural sector?, but the effort has met with little success, rued a leading daily.

An editorial in the Dawn Thursday said the latest but as yet unpublished agriculture census finds that up to 80 percent of the people in the country?s farming sector own just 28 percent of all privately-owned agricultural land.

?The bland statistics obfuscate one of the most serious disconnects in the country,? it said.

?Whichever sector is examined, be it agriculture, healthcare, education or practically any other, the elite ? who constitute a fraction of the overall population ? are using up the overwhelming bulk of the available resources. In plain terms, the minority appropriates what the majority needs to pull itself out of its misery,? the daily added.

The editorial said that ?for decades the country has flirted with the idea of imposing taxes on the agricultural sector so that the economy as a whole can benefit. The effort has met with little success, given that in many cases the elements that have the power to bring about a veto are the very ones that have large and lucrative stakes in agricultural land and the related economy?.

?Will a government ever have the will to bring agriculture into the tax net?? it asked and added: ?That remains a moot point.?

Asexuals Aren't Unicorns

The asexual community is starting to gain visibility, but many people ? even some researchers and sex educators ? still consider them unicorns. One look at the well-frequented and educational website of AVEN, the Asexual Visibility and Education Network, is enough to dispel that particular myth. Since having been founded by David Jay in 2001, AVEN has become the world?s largest asexual online community, with Salon.com having called it the ?unofficial online headquarters? of the asexual movement. A study by Anthony F. Bogaert, published in the Journal of Sex Research in 2004, estimated the number of people who have never experienced sexual attraction at about 1%.

A person who is asexual doesn?t experience sexual attraction to other people, regardless of sex or gender. Obviously, that doesn?t make them emotionless clay tiles though. Asexuals still have emotional needs and, like sexual people, fulfill them in a variety of ways. Some, though not all, also experience romantic attraction and/or physical arousal, but not all experience them the same way. As sexual and romantic attraction work independently of each other, some asexuals can also identify as lesbian, bi, straight, or gay, depending on who they prefer having relationships with. Yes, some asexuals can have and desire having relationships, including with sexual people. Like all successful relationships, they require honesty and good communication, but are entirely possible.

Now, let?s tackle some of the most common misconceptions people who are unfamiliar with asexuality have.

Asexuality is not the same as celibacy. People can choose to be celibate for a variety of reasons; asexuals, however, choose their orientation as little as bisexual, lesbian, gay or straight people. It is not caused by abuse, sexual repression or mental illness. Most asexuals simply feel neutral about sex, though there are also some who would find participating in anything sexual with another person entirely repulsive. Asexuality can?t be cured, and trying to do so would be harmful to the asexual person.

Another challenge asexuals face in everyday life is living in a society that places such a high value on sex. We?re all surrounded by sexual images and messages, and it can be difficult for asexuals to deal with the expectations society places on them. In a world where most people expect everybody to be sexually interested in others, it?s easy to feel alienated. And then there?s also that question. How can you know you?re asexual when you?ve never had sex with somebody? Sounds familiar, if you?re anything other than traditionally straight, doesn?t it? Let me answer this with a counter question: How can you know you?re straight (or bisexual or gay) when you?ve never had sex with somebody?

With all that said, if you used to experience sexual attraction and a sex drive and they suddenly vanished, you should seek out a medical professional. It could be a sign of something more serious, a hormonal imbalance or a side effect of medication.

(AP) ? From the beginning, Michelle Obama's kitchen garden has been an overachiever, churning out more peppers, parsley and eggplant than expected, and generating interest that ? yes, really ? crosses oceans.

Now, the first lady has added a 271-page book to her gardening resume, and Americans can read all about the planting misses that came with the hits, get tips on gardening at home, and, Mrs. Obama hopes, draw some inspiration that just might change their lives. Oh, and if it happens to help her husband's re-election campaign, that would be nice, too.

Lofty goals for a book about a garden.

In "American Grown: The Story of the White House Kitchen Garden and Gardens Across America," Mrs. Obama holds out the raised vegetable beds on the South Lawn as "an expression of my hopes" for the nation's children. "Just as each seed we plant has the potential to become something extraordinary, so does every child," she writes.

The $30 book, released Tuesday by Crown Publishers, traces how a city kid from the South Side of Chicago who became a working mother and then a political spouse found herself fretting on that first planting day, March 20, 2009, about whether an L-shaped stretch of soil would prove fertile ground for a national conversation "about the food we eat, the lives we lead, and how all of that affects our children."

The book, which answers that question with a resounding yes, arrives just in time for her husband's re-election campaign.

And while the book is decidedly non-political, that fits perfectly with the Obama campaign's view that the first lady can do her husband a world of good simply by pushing the non-threatening causes such as healthy living that have made her a far more popular figure than the president himself. Mrs. Obama's favorability rating in the latest AP-GfK poll was 70 percent, compared with 58 percent for her husband.

The book's release comes with a flurry of media appearances. She's already been a TV frequent flyer to promote her "Let's Move" campaign to combat childhood obesity ? doing pushups with Ellen DeGeneres, playing tug-of-war with Jimmy Fallon in the White House and serving veggie pizza to Jay Leno. She says she gets asked about the garden wherever she goes, around the world.

The book is chock full of colorful, glossy photos of luscious-looking vegetables, complete with a cover picture in which the first lady's blouse seems to be color-coordinated with the eggplants in her bulging basket of produce. Bo, the popular family dog, gets plenty of cameo appearances. There are maps tracing the growth of the garden over the past three years, and stories about community gardens around the country. Even a how-to on creating a compost bin.

The book is divided into four sections marking the seasons, and includes a complement of recipes for each.

There are inside stories about planting travails that will ring true with any weekend gardener: pumpkins that wouldn't grow, cantaloupes that tasted blah, blackberry bushes that wouldn't play nice with the raspberry bushes and an invasion of cucumber beetles, among them. The first lady makes clear she's not the one doing most of the hoeing and weeding, crediting school kids, White House chefs and grounds crew and enthusiastic volunteers from all over the White House chain of command with providing lots of manpower.

And there are bits of historical trivia woven throughout: John Adams ordered up the first White House garden, but it was never harvested after he lost re-election. Thomas Jefferson was obsessed with trying to grow a four-foot-long cucumber. Heiress Rachel "Bunny" Mellon, at 101 now a figure in the John Edwards' corruption trial, helped redesign the Rose Garden for President John Kennedy.

There are also bits of personal history: Mrs. Obama's father worked as a boy on one of the vegetable trucks that would deliver produce to neighborhoods, and had a reputation for sneaking pieces of fruit. Her mother's family had a plot in a neighborhood victory garden on the corner of an alley, and the kids had to eat their vegetables or go to bed without supper.

It is a tradition for first ladies to use books to advance their causes. Hillary Clinton wrote the best-seller "It Takes a Village," about the importance of community in raising children; and Laura Bush collaborated with daughter Jenna on a picture book about a reluctant reader, with "Read All About It!"

This is Michelle Obama's first book. She got no advance payment, and plans to donate all her proceeds to the National Park Foundation for programs that promote gardening and healthy eating, and to help care for the White House garden.

COLLEGE BASEBALL: Metzger's quite the hit, for the opposing teams

LBSU center fielder has a knack for being hit by a pitch, and it's just fine with him.

Talking about Brennan Metzger's talents as a four-year starter at Long Beach State requires mentioning his speed on the bases (42 career steals), his average of a hit a game the last three seasons, being third on the all-time list in doubles, his superb defense in center field (three errors in four seasons), and that he leads the 2012 Dirtbags in virtually every category.

But one area always begins the conversation:

What's his special talent for being hit by opposing pitchers?

What is the favorite hit by pitch in his career?

Which HBP hurt the most?

Metzger has "taken a dose" of ball-inflicted pain 54 times in his career, leaving him two behind Bryan Kennedy on the program's all-time list.

Metzger was hit by a pitch eight times in 2009, 20 times in 2010 (tied for third all-time in a single season), 11 in 2011 and 15 times in 2012.

Metzger chuckled at the questions about his Craig Biggio-like ability. His talent comes natural, from his aggressive nature. He set the career record for HBP at Mission Hills High, too. He doesn't have a favorite because they all get him on base, though any that just nipped a piece of his jersey or the thick part of his shoulder were preferable to the few he took in the small of his back.

"I have a lot of favorites," he said. "They're all important because you get on base and that's a big part of baseball. There have been a few times I've crowded the plate looking for

one just because we needed a baserunner. But most just come naturally."

The one that hurt was a 94-mile per hour fastball he took on his elbow in a game against UC Santa Barbara as a freshman that took him out of the lineup for a month.

Metzger has had as much to do with the Dirtbags turning the season around after a heartbreaking start to the season - nine one-run losses, several walk-off defeats - as anyone.

A leadoff hitter much of his career, this season he's hit in every spot in the order other than second, eighth or ninth. He moved into the No. 5 spot when Big West Conference play began and he leads or is tied for the lead in 10 different categories just for conference games, including a .416 average, 19 runs scored, 21 RBIs, eight doubles, .484 on-base percentage and .558 slugging percentage.

He's made just two errors in the last three seasons, and one of the calls was specious. With inexperienced outfielders flanking him in center this season, Metzger has covered more acreage in Blair than a herd of cattle at an Alta-Dena dairy.

This weekend's series is highly personal for him. The Dirtbags can win the Big West title and earn a trip to the postseason by taking two of three from the Titans. It would be his first postseason in his final season.

When Metzger arrived, the Dirtbags had just won the 2008 Big West title and made their seventh postseason appearance in the last eight years. He had every reason to believe he would help continue that streak. Instead, the Dirtbags fell in the dirt and didn't get up.

"That was the opportunity I was looking forward to when I came to the program," he said. "So it's hard to realize this is our first real opportunity to win a title and go to the postseason. I don't think some of my teammates can appreciate it the way (senior catcher) Kellen Hoime and I do. We've had four years of waiting. It's our last shot."

Metzger is one of the few players in the last quadrennial to fully embrace the Dirtbag ethos and play the game the way it was formed by Dave Snow two decades earlier. It showed on his always-dirty jersey and on his frustrated face at the end of each season.

"That first year (2009) I was just trying to find my niche," he said. "I don't think we appreciated the fact that we had 11 players drafted off the 2008 team. That year I didn't play under control. I was amped up too much."

The 2010 season was the one that disappointed him most. The team had nine players who are playing pro baseball now, but it was erratic all season and then swooned, going 3-14 the rest of the season and putting a disrespectful tag on the career of head coach Mike Weathers, who announced his retirement late in the season.

"I was so excited going into that season, the whole team had real high expectations," he said. "Instead we wore Weathers out. Just knowing we didn't live up to what we had or the program's tradition was disappointing."

He was a draft-eligible junior after the 2011 season and was prepared to start a pro career, but he wasn't drafted, a victim of the new BBCOR bats that sucked the power out of the game and left him with a .267 average.

Coming back for a senior season has worked in his favor. Buckley moved him from the top of the lineup to the fifth spot because he had extra-base power and was simply clutch. Once known as the guy who would get on base and score, he became the guy who is driving in runs.

"The difference between last year and this is that I'm out of my head," he said, referring to over-thinking and over-analyzing things. "I like hitting where I am now. It's given me a chance to contribute in different ways."

"He's always been strong at (pitch recognition)," Buckley said.

"He uses the whole field now and he's become the one guy we let steal on his own because he makes good decisions. And he's always been a quality center fielder, one of the best defensive center fielders the program has ever had.

"He's having a career year and moving him down in the lineup stretched out our lineup strength. He's been very productive and has been our best hitter in two-out situations."

Plus, he has that high tolerance for pain going for him. This weekend, he'll take as many pitches off his body as it takes to win twice and finally get to the place he came to Long Beach for, the postseason.

Tropical storm warnings issued for Northeast Florida, Southeastern U.S. coast

MIAMI ??Tropical storm warnings have been issued for the Southeast coast from north Florida to South Carolina as a cluster of thunderstorms was gathering strength Friday night and expected to become Tropical Storm Beryl over the Memorial Day weekend.

The National Weather Service said that the storm's maximum sustained winds were at 45 mph. But they are expected to increase as the storm slows down when it moves over the waters of the Atlantic.

The system was about 305 miles (490 kilometers) from Charleston, S.C., at 11 p.m. and swirling toward the Southeast coast.

Tropical storm warnings were issued for the Volusia/Brevard County line in Florida to Edisto Beach, S.C., and watches from Edisto Beach to the Santee River. The storm is expected to eventually move southwest and the Georgia coast and northern Florida could see heavy rains starting Sunday and into next week.

Higher than normal tides will be crashing against the Southeastern coast and may cause flooding. Heavy rain is forecast. Dangerous surf was expected along the coasts of northeastern Florida, Georgia and South Carolina over the holiday weekend.

Forecasters are classifying the storm as subtropical, which has more to do with how the center of the storm is forming, not wind speed, according to Weather Underground's website.

Often when subtropical storms remain over warm water for several days, they become tropical because thunderstorms start building close to the center.

Forecasters were not indicating that the storm would become a hurricane.

They are ideal for large spaces and for those who want to cater to more than one room, using just as one machine.

NATO summit: The Taliban's view

The Taliban issued a statement ahead of today's NATO summit in Chicago, expressing frustration with the coalition's moves to 'prolong the occupation.'?

Hours before the start of a major NATO summit in Chicago, the Taliban's main spokesman released a lengthy statement signaling the insurgency was open to a political solution to the conflict, but accused NATO of "wavering in their stance" on negotiations.

"The Islamic Emirate has left all military and political doors open,"?read the statement, written in English and attributed to spokesman?Zabihullah Mujahid. "[H]owever the invaders are utilizing a one step forward, two steps backwards tactic. They are conjuring artificial excuses to prolong the occupation of Afghanistan, are wavering in their stance and do not seem to have a clear strategy for a political solution."

Until NATO stops wavering, the statement continues, the Taliban considers the coalition's calls for talks to be "meaningless."

It was the Taliban who suspended negotiations in March following the burning of the Quran on a US base and a shooting spree by a US soldier.?But the United States and NATO have continued to talk of seeking a negotiated settlement to the 11-year conflict.

Most recently, President Obama backed negotiating on a visit earlier this month to Afghanistan. However, he also outlined a new strategic pact with the US-backed government in Kabul that would let some American soldiers stay in Afghanistan past 2014 until 2024.?

Obama's two-pronged message of peace talks but prolonged troop presence unsettled what appeared to be a Taliban strategy of running out the clock?on the US withdrawal target of 2014. The Taliban's statement today suggests the insurgency is irked by the move to "prolong the occupation."

Whether Mr. Obama's gambit pushes the Taliban to publicly return to negotiations remains to be seen. While today's statement signaled openness again to negotiations, it also expressed doubts about NATO's sincerity in wanting to leave.?

"The foreigners should forgo prolonging and complicating the Afghan issue for their colonialist objectives," the statement reads.

It goes on to remind NATO that, despite the 2024 extension, there are domestic pressures to wrap up the war soon. The statement cites a recent?CBS News/New York Times poll in which 69 percent of respondents?said the US shouldn't be involved in Afghanistan. Indeed, Monitor polling on the new US-Afghanistan strategic pact found nearly two-thirds of?Americans reject the broad outlines of the deal.?

The Taliban statement also reiterated the group's stance that they were not involved in the 9/11 attacks and will not allow Afghan soil to be used to launch attacks on other countries.?

"The Islamic Emirate once again declares that it holds no agenda of harming anyone nor will it let anyone harm other countries from the soil of Afghanistan hence there is no reason for the occupying countries including America to continue the occupation of Afghanistan under the pretext of safeguarding its own security," the statement reads.?

NATO helped overthrow the Taliban government in 2001 after the regime failed to hand over Al Qaeda chief Osama bin Laden in the days following the Sept. 11, 2001, attacks.?

Activists: Toll from Syrian attack more than 90

BEIRUT (AP) ? Government troops shelled a string of villages in central Syria before pro-regime thugs swept through the area, shooting people in the streets and in their homes in attacks that killed more than 90 people, activists said Saturday.

The assault on Houla, an area northwest of the central city of Homs, is one of the bloodiest single events in Syria's 15-month-old uprising.

Activists from the region said regime forces peppered Houla with mortars following a large anti-regime protest on Friday. After the bombardment, pro-government thugs known as shabiha raided the villages, killing men on the streets and stabbing women and children in their houses.

Amateur videos posted online showed scores of dead covered in sheets and blankets, some covered with chunks of ice to preserve then until burial. One video showed 14 dead children lined up on the ground, shoulder to shoulder. Another had at least a dozen more, some with holes in their heads and faces, lying on what appears to be the floor of a mosque.

The Syrian government blamed the massacre on "armed terrorist groups" but provided no details or death toll.

The killings strike a stiff blow to an international peace plan brokered by envoy Kofi Annan meant to end the violence in Syria. The basis of the plan is a cease-fire between President Bashar Assad's forces and rebels seeking to topple the Syrian regime. It was supposed to start on April 12 but has never really taken hold, with pockets of daily violence.

The U.N. put the death toll weeks ago at more than 9,000. Hundreds have been killed since.

U.N. Secretary-General Ban Ki-moon said Friday that there has only been "small progress" on implementing the plan and blamed the Syrian government for much of the "unacceptable levels of violence and abuses." Annan is supposed to visit Syria soon to check on the plan's progress, though no date has been announced.

On Saturday, French Foreign Minister Laurent Fabius condemned the attack on Houla, saying that "with these new crimes, this murderous regime pushes Syria further into horror and threatens regional stability."

Abu Yazan, a local activist reached via Skype, said regime forces fired shells at the villages that make up Houla, an area about 40 kilometers (25 miles) northwest of the city of Homs after an anti-regime demonstration Friday.

He said local rebels fighting under the banner of the Free Syrian Army tried to fight the army off in clashes around the area before pro-regime thugs known as shabiha stormed the villages, raiding homes and shooting at civilians.

The Britain-based Syrian Observatory for Human Rights said more than 90 people were killed in the Houla area. Abu Yazan said 106 people were killed, most of them in the village of Taldaw. More than 40 were children, he said.

"They killed entire families, from parents on down to children, but they focused on the children," he said.

Another activist, Abu Walid, said that many of the women and children had stab wounds.

The activists said the Houla killings appeared to be sectarian, raising fears that Syria's uprising, which started in March 2011 with protests calling for political reform, is edging closer to the type of sectarian war that tore apart its eastern neighbor, Iraq.

The Houla villages are Sunni Muslim. Activists said that the pro-regime forces all came from an arc of villages south of Houla that are populated by Alawites, members of the offshoot of Shiite Islam to which Assad belongs.

"Our area is Sunni and the surrounding villages are Alawite," Abu Walid said. "I don't like to talk about sectarianism, but it was clear that this was sectarian hatred."

Amateur videos posted online showed dozens of bodies laid out in different rooms, including women wearing Muslim headscarves and children in shorts and T-shirts.

Syrian state TV blamed the "massacre" in Houla on "armed terrorist groups" ? a term it often uses for the opposition.

The claims and videos could not be independently verified. The Syrian government bars most media from operating inside the country.

Anti-regime groups, who have expressed frustrations with the international community's reluctance to intervene in Syria's conflict, strongly condemned the killings.

World powers have fallen in behind the U.N. plan, which is supposed to lead to dialogue between all sides on a political solution. The U.S. and European nations say they will not intervene militarily. Saudi Arabia, Qatar and Libya have said they will arm Syria's rebels, although no country is known to be doing so now.

A spokeswoman for the opposition Syrian National Council called on the U.N. Security Council "to examine the situation in Houla and to determine the responsibility of the United Nations in the face of such mass killings, expulsions and forced migration from entire neighborhoods."

The London-based Syrian Observatory for Human Rights released an unusually harsh statement, saying Arab nations and the international community were "partners" in the killing "because of their silence about the massacres that the Syrian regime has committed."

The U.N. has sent more then 250 military observers to Syria to try to salvage the cease-fire, and a spokesman for the team said they visited Houla on Saturday.

One Houla activist said the observers' visit would not help and could cause the government to attack again.

"As soon as they came we asked them to leave because many areas they go to get attacked," Abu Suleiman said via Skype. "We don't want them to get near us."

Also Saturday, the expected release of a group of Lebanese Shiites who were kidnapped in Syria this week appeared to hit a snag, a day after the Lebanese government confirmed the men had been freed and were on their way to Beirut.

Lebanese and Syrian officials have blamed Syrian rebels for Tuesday's kidnappings of the 11 men in northern Syria, but nobody has claimed responsibility.

A plane was scheduled to fly the men from Turkey to Beirut Friday night, but Lebanese officials said their arrival would be delayed for "logistical reasons."

The kidnappings fueled fears that Lebanon is getting drawn into the bloody conflict in Syria. In the hours after Tuesday's abductions, protests erupted in Beirut's Shiite-dominated southern suburbs.

When Angelina Jolie struck her much-lampooned pose at the Oscars in February, little did we know that months later we'd still be up in arms about stars' legs on the red carpet.

An informal survey of?entertainment slideshows?-- and other places on the Internet where attractive body parts are showcased -- reveals that legs attached to female celebrities appear to be stepping out more than normal of late.

Certainly showing a little skin or a lot of leg is nothing new, especially in Hollywood. Jolie made news for going a step (sorry, these puns are?way too?easy) further when her gam got glam and leapt 2 feet out of her black gown.

Now every star in a dress with a high slit is being compared to Jolie, even if they're just standing there with no intention?of turning an appendage into an Internet meme. Well, except for?model Anja Rubik and her hip bone at the Costume Institute Gala earlier this month. That's no ordinary pose.

Check out this random sampling of a few well-known celebrities. Are these outfits over the top? I'm no dressmaker, but the physics of being able to walk while wearing a long gown demands that that gown have a little give. Jolie went beyond the give part and took her pose up a notch. Shareholders sue Facebook, NYSE comes calling

SAN FRANCISCO (Reuters) - The fallout from Facebook Inc's messy initial public offering widened on Wednesday as shareholders sued the social network and its bankers while a trading firm revealed a massive loss on the shares and threatened to seek "remedies."

The Nasdaq stock exchange also came under further pressure as a source close to the situation told Reuters that NYSE Euronext had opened discussions with Facebook about a potential stock listing there. Nasdaq also faces litigation from angry investors.

Facebook's listing, envisioned as a crowning moment for an eight-year-old company that has become a business and cultural phenomenon, has instead turned into a legal and public relations fiasco for the company and its lead underwriter, Morgan Stanley.

Serious trading glitches interfered with the stock's opening on Friday, and subsequent revelations by Reuters that analysts had quietly reduced their revenue forecasts prior to the IPO have led to accusations of selective disclosure of material information. The shares closed at $32 on Wednesday, 15 percent below the IPO price.

A lawsuit filed on Wednesday seeking class-action status alleged that defendants -- including Facebook, its Chief Executive Mark Zuckerberg, Morgan Stanley, Goldman Sachs Group Inc and JPMorgan Chase & Co -- concealed "a severe and pronounced reduction" in revenue growth forecasts resulting from greater use of Facebook's app or website through mobile devices.

It also accused Facebook of telling its bank underwriters to "materially lower" their forecasts for the company. The lawsuit said the underwriters disclosed the lowered forecasts to "preferred" investors only.

"The main underwriters in the middle of the roadshow reduced their estimates and didn't tell everyone," said Samuel Rudman, a partner at Robbins Geller Rudman & Dowd, which brought the lawsuit. The firm is among the leading securities class actions firms in the country.

"I don't think any investor in Facebook wouldn't have wanted to know that information."

Andrew Noyes, a Facebook spokesman, said: "We believe the lawsuit is without merit and will defend ourselves vigorously."

Morgan Stanley had no comment. It said on Tuesday that Facebook IPO procedures complied with all applicable regulations and were the same as in any initial offering.

Also on Wednesday, Knight Capital Group Inc said its second-quarter results will be hurt by losses related to numerous issues during the listing. The firm, which provides electronic trading services to brokers and retail clients, foresees a pre-tax loss of $30 million to $35 million related to the IPO.

The company has submitted claims for financial compensation from Nasdaq OMX and is considering all legal remedies available, Knight Capital said in a regulatory filing.

Knight Capital's announcement may be a sign of things to come as other traders and investors tally up losses from the trading problems.

Nasdaq OMX was also sued on Tuesday by an investor who claimed the exchange operator was negligent in handling orders for Facebook shares. Morgan Stanley said it is reviewing Facebook trades and would adjust prices for some retail customers who overpaid.

A source familiar with the situation told Reuters that NYSE Euronext had opened discussions with Facebook about a potential stock listing there, and that the social networking giant was considering its options.

The largest U.S. exchange later denied it was discussing a full listing transfer with the company, which became the first U.S. company to debut with a market value of over $100 billion.

IPO INVESTIGATIONS

Wednesday's lawsuit, one of several that have been filed around the country, was brought in New York on behalf of Dennis Palkon and Brian Roffe, who said they respectively bought 1,800 and 200 Facebook shares at the IPO price, and Jacob Salzmann, who said he paid more than $123,000 on May 18 for 2,961 shares at an average $41.77 each.

Research analysts at several underwriters lowered their forecasts for Facebook after the Menlo Park, California-based company in a May 9 prospectus cautioned investors about the possible impact of users shifting to mobile platforms. Facebook currently makes little revenue from mobile ads.

Citing people with direct knowledge of the matter, Reuters reported this week that, during its IPO road show, Facebook advised analysts for its underwriters to reduce their profit and revenue forecasts.

The lawsuit named underwriters Morgan Stanley, Goldman Sachs, JPMorgan and Bank of America Corp as having cut their forecasts after the May 9 prospectus was filed, but that these cuts were not publicly revealed before the IPO. [ID:nL4E8GM8SK][ID:nL1E8GN0FT]

The plaintiff-shareholders called the disclosures of Facebook's business risks inadequate, saying that analysts knew more about these risks and cut their business outlooks accordingly -- for the benefit of only some investors, not all.

"If Facebook told analysts to materially lower their forecasts, it should have told the entire market," said Antony Page, a professor at the Indiana University Robert H. McKinney School of Law. "We need to know what exactly was said to the analysts, and determine how different Facebook's public story was from its private story."

Regulators including the U.S. Securities and Exchange Commission, the Financial Industry Regulatory Authority, and Massachusetts Secretary of the Commonwealth William Galvin are now looking into how the IPO was handled. The U.S. Senate Banking Committee is also reviewing the matter.

"If Facebook faced a known and particularly salient risk, boilerplate language would be insufficient," said Elizabeth Nowicki, an associate professor at Tulane University Law School and a former SEC lawyer.

Bank of America and Barclays Plc are also defendants in the New York case, as are Facebook Chief Financial Officer David Ebersman and several Facebook directors.

Bank of America spokesman Bill Halldin, Barclays spokesman Mark Lane and Goldman spokesman Michael DuVally declined to comment. JPMorgan did not respond to requests for a comment.
